Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Trish (“Trish,” “we,” “us,” or “our”), operated by Joshua Rohricht, a sole proprietor doing business as “Trish,” located at 40 E Oak St 1610, Chicago, IL 60611. These Terms govern your access to and use of the Trish iOS application and related services (the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy (available at trishapp.com/privacy), which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
1. Eligibility; Who May Register
Trish is a children's homework coaching app used by children under the supervision of a parent or legal guardian. Only a parent or legal guardian who is at least 18 years old may create a Trish account. Children do not create their own accounts and may not agree to these Terms.
By creating an account and any child profile, you represent that: (a) you are the child's parent or legal guardian, or otherwise have legal authority to consent on the child's behalf; (b) you are at least 18 years old; and (c) all information you provide during registration is accurate.
You are responsible for supervising your child's use of the Service and for all activity that occurs under your account.
2. Description of the Service
Trish is an AI-powered, voice-based homework coaching tool. A child speaks answers to homework questions, and an AI coach — using a Socratic questioning method — provides guidance intended to help the child work toward answers themselves. Trish is an educational supplement, not a substitute for a teacher, tutor, or classroom instruction, and it does not guarantee any particular educational outcome, grade, or level of academic improvement.
AI-generated content notice. The Trish AI coach generates responses using artificial intelligence (provided by our vendor, Anthropic) and may occasionally produce inaccurate, incomplete, or imperfect guidance, in the same way any automated system can make mistakes. Parents are responsible for reviewing their child's homework and overseeing their child's education; Trish is a supportive tool, not an authoritative source of academic truth.
3. Account Registration and Parental Responsibility
To use Trish, a parent must register an account using a valid email address and password, and may then create one or more child profiles. You agree to: provide accurate registration information; keep your login credentials confidential; notify us promptly of any unauthorized use of your account; and be solely responsible for supervising and managing your child's use of the Service, including the content your child submits (such as spoken answers or worksheet images).
4. Subscription, Billing, and Cancellation
a. Subscription fee. Trish is offered as a paid subscription at $4.99 per month, billed through Apple's In-App Purchase system (StoreKit).
b. Billing and auto-renewal. Your subscription will automatically renew at the then-current price at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Payment will be charged to your Apple ID account at confirmation of purchase, and your account will be charged for renewal within 24 hours prior to the end of the current period.
c. Managing or canceling your subscription. All billing, renewal, and cancellation of subscriptions is handled through your Apple ID account settings, not through Trish directly. You can manage or cancel your subscription at any time in your iOS device's Settings app under Subscriptions.
d. Refunds — all sales final. All purchases made through the Service are final. Trish does not process or issue refunds directly; because payments are processed by Apple, refund requests are subject to Apple's App Store refund policies and must generally be requested through Apple. If you have a billing issue or question, contact us at trishapp@trishapp.com and we will do our best to assist.
e. Price changes. We may change subscription pricing from time to time. Any price change will apply prospectively and, where required, will be presented to you through the App Store prior to renewal at the new price.
5. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Trish app on Apple-branded devices that you own or control, solely for your personal, non-commercial, family use, and solely in accordance with Apple's Usage Rules set forth in the App Store Terms of Service. All rights not expressly granted to you are reserved by Trish.
6. User Content
“User Content” means any content submitted through the Service, including a child's spoken answers, worksheet images, and any text or information a parent or child provides. You (as the account-holding parent) retain any rights you may have in User Content. By submitting User Content, you grant Trish a limited, non-exclusive, worldwide, royalty-free license to use, process, transmit, and display that content solely as necessary to operate and provide the Service (for example, sending a worksheet image to our AI vendor for analysis, or a spoken answer to our transcription vendor). We do not claim ownership of your or your child's User Content, and we handle it as described in our Privacy Policy.
You represent that you (and your child, under your supervision) have the right to submit any User Content provided through the Service.
7. Prohibited Uses
You agree not to: use the Service for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to the Service, other accounts, or our systems; interfere with or disrupt the integrity or performance of the Service (including attempting to bypass rate limits or security measures); reverse engineer, decompile, or disassemble the App except as permitted by applicable law; use the Service to submit content that is unlawful, abusive, or that infringes another's intellectual property or privacy rights; misrepresent your identity or age, or create an account on behalf of a child without being that child's parent or legal guardian; or use the Service to develop a competing product or to scrape, harvest, or extract data from the Service.
8. Intellectual Property
The Service, including its software, design, text, graphics, the Trish name and logo, and all related intellectual property, is owned by Trish or its licensors and is protected by U.S. and international intellectual property laws. Nothing in these Terms grants you any right to use Trish's trademarks, logos, or brand features without our prior written consent.
9. Copyright / DMCA Policy
We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe content available through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”) to our designated DMCA agent:

Your notice must include: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. If you believe your content was removed in error, you may submit a counter-notice with comparable information to the same contact above.
10. Third-Party Services
The Service relies on third-party providers (including Anthropic, ElevenLabs, Google Cloud, Supabase, Lovable, Upstash, Resend, and Apple) to operate. Details of how these providers process information are described in our Privacy Policy. Your use of the Service is also subject to Apple's App Store Terms of Service, and, to the extent applicable, Apple's own terms and policies.
Acknowledgment regarding Apple. You acknowledge that these Terms are between you and Trish only, not with Apple Inc. (“Apple”), and Apple is not responsible for the Service or its content. Apple has no obligation to furnish any maintenance or support services for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price for the App to you (to the extent applicable); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service. Apple is not responsible for addressing any claims by you or any third party relating to the Service, including but not limited to: (a) product liability claims; (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights. You agree to comply with any applicable third-party terms when using the Service. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED COACHING RESPONSES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR EDUCATIONAL PURPOSE. TRISH IS AN EDUCATIONAL SUPPLEMENT ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL EDUCATIONAL INSTRUCTION.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRISH AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify, defend, and hold harmless Trish and Joshua Rohricht from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: your violation of these Terms; your (or your child's) use of the Service; or User Content you submit through the Service.
14. Termination
You may stop using the Service and delete your account at any time using the “Delete Account” option in the app, or by contacting trishapp@trishapp.com. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive conduct, or for any other reason at our discretion, including discontinuation of the Service. Upon termination, your right to use the Service ceases immediately; data deletion following termination is handled as described in our Privacy Policy.
15. Governing Law; Dispute Resolution
a. Governing law. These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles, except to the extent preempted by U.S. federal law.
b. Informal resolution first. Before filing a claim against Trish, you agree to first contact us at trishapp@trishapp.com and attempt to resolve the dispute informally for at least 30 days.
c. Venue. Subject to Section 15(b), any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by email before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
17. Miscellaneous
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trish regarding the Service and supersede any prior agreements. No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision. Assignment. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
